PROACTIVE ELDER LAW
Taking steps to control your assets for when you are no longer capable of controlling them. Being proactive usually means less expense and a greater extent of protection. We can help you and your family gain the most protection you desire by being proactive in your planning.
CRISIS ELDER LAW
Reacting to a crisis is usually more expensive than being proactive, but there are effective ways to protect a significant amount of assets even when you are already in the nursing home. We can help you and your family achieve the most protection in a crisis while qualifying for Medicaid Long Term Care benefits.
SPECIAL NEEDS
Good intentions can create bad results if attention isn’t paid to special needs beneficiaries. You can be very effective and helpful if you are aware, but you can be destructive to the beneficiary if you are not. We can help you structure your plan to best help your beneficiary.
BUSINESS
Business formation and maintenance is necessary to preserve liability protection and provide opportunities for business succession within families or the sale of a business when the owner retires. We can help you structure your business, work with you to keep your personal assets protected over time and integrate your business planning into your estate plan.
ESTATE SETTLEMENT
Both at disability and death.
PROBATE
We guide families through the court supervised process of probate when it is required by law.
TRUST (DISABILITY)
We guide successor trustees through the process of determining disability of the prior trustee and assist with the trustee transition when appropriate.
TRUST (DEATH)
We guide families through the statutory process of settling a trust after the death of the creator. There are formal requirements that do have time deadlines now, so it is imperative that trustees act quickly after the creator’s death to begin the settlement of a revocable trust.
BUSINESS
We help families through the process of inheriting a business as well as closing a business after the death of the owner, if that is desired. We do not handle the sale of a business, but we work with those who provide appropriate assistance.
